Warranty terms and conditions

This warranty is provided by T.C Boxes Australia Pty Ltd ABN 78 646 286 615 (referred to as “we”, “our” or “us”) with respect to each of the following products that we manufacture and sell:

(each a “T.C Boxes Product”).

For the purpose of this warranty document, ‘you’ or the ‘customer’ means the end-user of the relevant T.C Boxes Product.

Nothing in this document limits or is intended to limit your rights or remedies under the Statutory Guarantees of the Australian Consumer Law. To the extent that any provision of this warranty is inconsistent with the Statutory Guarantees, that provision is severed and does not affect the enforceability of the remaining terms.

Note for Australian consumers only: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. These rights apply regardless of anything set out below.

T.C Boxes Australia Pty Ltd makes no other express warranty or condition other than set out in this warranty, whether written or oral.

What does this warranty cover?

This warranty only covers a T.C Boxes Product if it is initially purchased from, and installed by, an authorised T.C Boxes retailer, and used in accordance with the terms and conditions set out in the applicable installation manuals and guidelines that apply to the T.C Boxes Product (being those installation manuals and guidelines that are either supplied with the T.C Boxes Product at the time of sale or shared via email) (the “Installation Manuals or Guidelines”).

What is our warranty period?

For T.C Boxes Products that have a date of initial sale that is after 17 September 2021 (as evidenced by the receipt or invoice for the T.C Boxes Product) the warranty period expires on the date that is 24 months following the date of initial sale of the T.C Boxes Product.

For T.C Boxes Products that have a date of initial sale that is on or before 17 September 2021 (as evidenced by the receipt or invoice for the T.C Boxes Product) the warranty period expires on the date that is 12 months following the date of initial sale of the T.C Boxes Product

If any T.C Boxes Product is replaced under this warranty, then the replacement T.C Boxes Product will receive the benefit of the remaining warranty period from the date of initial sale of the original T.C Boxes Product that has been replaced until the expiry of that warranty period.

Under what circumstances can a warranty be claimed?

If the T.C Boxes Product fails to be of acceptable quality and the failure does not amount to a major failure, we will, at our cost but choosing, replace the defective T.C Boxes Product or repair the defective T.C Boxes Product, either:

  • onsite by a suitably qualified technician; or
  • offsite at an authorised repair facility.

For a ‘major failure’, you are entitled to a replacement or refund and compensation for any other reasonably foreseeable loss or damage.  A major failure has the meaning given to that term in the Australian Consumer Law. It includes but is not limited to a failure to comply with a guarantee referred to in section 259(1)(b) of the Australian Consumer Law.

In the event we elect to or are required to replace a T.C Boxes product and an exact replacement isn’t available, then an equivalent product will be provided.

What is not covered by this warranty?

This warranty does not cover any direct or indirect loss or damage to the T.C Boxes Product or any other appliance, equipment, service or property caused by:

  • failure to install or operate the T.C Boxes Product in accordance with the applicable Installation Manuals or Guidelines;
  • the T.C Boxes Product which is not installed by us or a T.C Boxes authorised retailer;
  • failure to follow maintenance instructions for the T.C Boxes Product included with the applicable Installation Manuals or Guidelines;
  • connection of the T.C Boxes Product to any non-approved third-party products;
  • alteration of the T.C Boxes Product in any way (including custom fit-outs, custom paintwork or signwriting);
  • storage or transport damage to the T.C Boxes Product, including where T.C Boxes Products are lost or damage in transport back to us, including for a voluntary return;
  • unauthorised repair or alteration of the T.C Boxes Product including unauthorised substitution of non-standard parts or repair attempts;
  • force majeure events impacting the T.C Boxes Product (including war, acts of terrorism, nuclear accident, industrial action, earthquake, flood, fire, cyclone, storm, lightning or other physical natural disaster);
  • accidents, abuse, misuse or negligent acts impacting the T.C Boxes Product;
  • any damage that occurs in the act of theft or attempted theft (including of items that are stored within the T.C Boxes Product);
  • use of the T.C Boxes outside of normal operating conditions (including harsh off-road use and/or submerging in water); 
  • pest or other vermin damage, insect infestation, accidental breakage, corrosion, actions of third parties and other events or accidents impacting the T.C Boxes Product which do not arise from normal operating conditions;
  • environmental factors impacting T.C Boxes Product including, but not limited to, corrosion (whether by exposure to moisture, salt, chemicals, or other corrosive substances), exposure to extreme temperatures, humidity, sunlight, pollution, or other adverse environmental conditions;
  • any disclosed imperfections at the time of sale (including as part of any ‘factory seconds’ or ‘scratch and dent’ or similar sale promotion); or
  • normal wear and tear to the T.C Boxes Product including surface damage such as scratches.

This warranty does not cover any direct or indirect loss or damage to the T.C Boxes Product or any other appliance, equipment, service or property where a claim is made outside of the applicable warranty period.

This warranty does not cover any accessories or tools provided with the T.C Boxes Product or any promotional giveaway items. 

This warranty does not cover any ‘change of mind’ or similar returns.  

How to lodge a warranty claim?

In the event of a claim, the following steps should be taken:

  • You must lodge your warranty claim within 30 days of you first becoming aware of the failure or defect (“Claim Period”). If you do not lodge your claim within the Claim Period, we reserve the right to reject your claim.
  • In the first instance, you should contact your installer and/or supplier for support. DO NOT attempt to repair the T.C Boxes Product yourself.
  • Your installer and/or supplier will attend, investigate and diagnose issues and, if necessary, contact us for assistance.
  • In the event a warranty claim is required, your installer and/or supplier will lodge a claim on your behalf directly with us.
  • If you cannot reach your installer, or supplier, you must contact us directly by email to warranty@tcboxes.com.au
  • You must not return the T.C Boxes Product without prior, written authorisation by us. 
  • All return costs for warranty claims are the customer’s responsibility unless otherwise stated in this warranty.  The customer is also responsible for any courier or other delivery service they utilise for return of the T.C Boxes Product as part of a warranty claim.
  • The customer is responsible for all time, travel, and other personal costs associated with warranty claims.
  • A warranty claim will only be accepted if all criteria can be met and a fault or defect found that is not covered by an exclusion to this warranty.

All warranty claims require information to be provided to us upon request. Information required may include:

  • customer name and address;
  • serial number of the affected T.C Boxes Product;
  • proof of purchase and proof of installation by a qualified installer;
  • date the relevant defect or failure was discovered; and
  • complete details relating to the relevant defect or failure to allow technical assessment to be carried out including photos where relevant.

Failure to provide any information, including photographs, of the relevant defect may affect the validity of your return or warranty. 

What happens if a warranty claim is rejected?

If a claim on this warranty is rejected by us after the relevant T.C Boxes product has been assessed by us, you may be required to reimburse us for our reasonable costs associated with the claim. We will issue you with an invoice for those costs.

What happens if the customer is not satisfied with the outcome of a warranty claim?

If you are not satisfied with the outcome of a warranty claim, a request for review may be lodged with us by contacting us directly, explaining the grievance and providing any further evidence to support the grievance.

Upon receipt of any requests for review of a warranty claim, we will review any additional information that is provided by you and respond as soon as practicable, detailing the outcome and/or any proposed action. 

Jurisdiction

This warranty is governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
